Terms of service

The service

SmartSite Assistant is a platform that lets agencies and businesses run AI assistants on websites and in messaging apps such as WhatsApp. Agencies offer it to their clients under their own brand.

Accounts

Keep your sign-in details secret and tell us right away if you think someone else has access to your account.

Agencies are responsible for the people they invite, for their clients' use of the service and for the access they give them.

Acceptable use

Use the service lawfully. In particular:

• don't send spam or unsolicited messages, and only message customers who contacted the business or agreed to receive messages;
• follow Meta's WhatsApp Business Messaging Policy and Commerce Policy when you use WhatsApp;
• don't use the service for illegal, harmful, misleading or discriminatory content;
• don't try to break, overload or get around the security of the service;
• only add content you have the right to use.

Your content and data

Content you add (knowledge, settings, conversations) remains yours or your client's. You allow us to process it only to provide the service.

For personal data we process for you, we act as your processor as described in our privacy policy. A data processing agreement is available on request.

AI answers

Assistants generate answers automatically. They can be wrong or incomplete. You are responsible for the instructions and knowledge you give your assistant and for what it may promise your customers.

Third-party services

WhatsApp, Messenger and Instagram are services of Meta, and AI answers come from OpenAI. Their terms also apply, and their availability is outside our control. Meta may charge businesses directly for WhatsApp messages.

Fees

Prices and payment terms are agreed separately with each agency.

Availability and changes

We work to keep the service available and secure, but we can't guarantee it will always be available or free of errors.

We may improve and change the service. We tell you in advance about changes that affect you significantly.

Liability

To the extent permitted by law, we are not liable for indirect or consequential damage, such as lost profit or lost data, and our total liability is limited to the amount you paid us in the 12 months before the event. Nothing in these terms limits liability that can't be limited by law.

Ending the service

You can stop using the service at any time. We may suspend or end access if these terms are seriously breached.

After the service ends, we delete your data as described in our privacy policy.

Applicable law

These terms are governed by Croatian law. Disputes go to the competent court in Croatia, unless mandatory law gives you another option.
